Failing to contain a spillage of fuel oil has landed Scottish Coal Company Limited with a £2000 fine.
The company admitted causing or knowingly permitting fuel oil to enter a tributary of the Stottencleugh Burn in East Ayrshire at Ayr Sheriff Court on 22 December 2005
The Scottish Environment Protection Agency (SEPA) was alerted to the incident by a member of the public complaining of heavy oil residue on the surface of the burn.
SEPA investigating officer Peter Livingstone said: “When we investigated there was a strong smell of diesel oil from the burn and oil was visible on the surface of the water.”
The incident occurred at Spireslack when a fuel delivery hose became detached from a fuel pump while dump trucks were being refueled.
Peter Livingstone added: “While we recognise that the discharge was not done deliberately, Scottish Coal Company Limited did not take sufficient steps to stop the oil from entering the watercourse or to contain the spillage. The Stottencleugh Burn is a watercourse which feeds Glenbuck Loch and the River Ayr, which are both gamefisheries of considerable amenity value.”
The case was reported to the Procurator Fiscal by SEPA.
